1. Scope of application
These General Terms and Conditions (GTC) apply to the business relationship between mydream-Tours (hereinafter referred to as “Agent”) and the customer (hereinafter referred to as “Customer”) in connection with the provision of advice and the arrangement of travel services, but without assuming any guarantee for the performance of the individual services.
2. Services of the Agent
a. The Agent offers the Customer information and advice regarding individual services (e.g., flights, hotels, rental cars, activities) provided by various third-party providers.
b. The Agent does not act as a tour operator for package tours, but exclusively arranges individual trips or related travel services.
c. The agent accepts no responsibility for the performance of the services arranged. The performance of the respective services is the sole responsibility of the respective provider (e.g., airline, hotel, car rental company).
d. The agent accepts no liability for incorrect bookings, service disruptions, or cancellations caused by third parties (e.g., providers).
3. Conclusion of contract
a. The contract for a travel service is concluded directly between the customer and the respective provider (e.g., airline, hotel, car rental company). The agent acts exclusively as an information and consulting service provider.
b. The agent is not a contractual partner for the travel service, but merely provides information and arranges contact with the provider.
c. All bookings and payments are made directly with the provider. The agent is not involved in the payment process in any way.
4. Agency fee
a. An agency fee is charged for consulting and mediation services, which is based on:
- the travel price of the mediated service(s) and
- the individual effort involved in the consultation.
b. The amount of the agency fee will be communicated to the customer transparently before booking.
c. The agency fee is paid directly to the agent and is independent of payments to the providers of the travel services.
5. Obligations of the customer
a. The customer is responsible for the accuracy and completeness of the booking data.
b. The customer is obliged to obtain all relevant information and documents (e.g., passports, visas) for the respective trip in a timely and complete manner.
c. The customer must review and accept the general terms and conditions of the respective provider.

6. Liability of the agent
a. The agent is not liable for the proper performance of the travel services arranged. The provider is solely responsible for the performance of the services.
b. The agent shall only be liable for intent or gross negligence in the provision of advice and mediation of travel services. Liability for indirect or consequential damages (e.g., missed connecting flights or unused hotel accommodation) is excluded.
c. The agent's liability is limited to the amount of the agency fee paid by the customer to the agent.
7. Cancellation and changes
a. Cancellations or changes to the booking of travel services must be made directly with the provider. The agent accepts no liability for cancellations, changes, or refunds by the providers.
b. The customer must observe the cancellation conditions and change modalities of the respective provider.
8. Travel insurance
a. It is recommended that you consider taking out suitable travel insurance (e.g., travel cancellation, travel interruption, or international health insurance) before starting your trip. Travel insurance can help to cover financial risks in the event of unforeseen events such as illness, accident, or trip interruption.
b. Taking out travel insurance is voluntary and is the customer's own responsibility. Only the terms and conditions of the respective insurer are applicable.

9. Data protection
a. The agent collects, stores, and processes the customer's personal data only in accordance with legal regulations and the company's data protection policy.
b. The customer consents to the processing of their data if this is necessary for the provision of consulting and agency services. Further information on data protection can be found in the agent's privacy policy.
10. Responsibility for linked travel arrangements
a. If the customer books several travel services from different providers within a short period of time and these are considered linked travel arrangements (e.g., flight + hotel), the agent is not responsible for the connection between these travel services.
b. The customer is aware that this is not a package tour and that the provider of each individual service is responsible for its proper execution.
11. Final provisions
a. Should any provision of these GTC be or become invalid, the remaining provisions of these GTC shall remain valid.
b. Amendments or additions to these GTC must be made in writing.
c. The law of the Federal Republic of Germany applies to all disputes in connection with these GTC.
d. The place of jurisdiction is the registered office of the agent if the customer is a merchant or does not have a general place of jurisdiction in Germany.

Disclaimer: The agent accepts no liability for the performance of the travel services arranged. The contractual partners are the individual providers of the travel services (e.g., airlines, hotels, etc.).

Booking and payment: Booking and payment are made directly with the respective provider. The agent acts solely as a consultant and arranges contact with the provider.
